First – the 200,000 veterans have claims in the multi-district litigation cases – rather than suing with individual lawsuits.
Second – while plaintiffs’ attorneys characterized the current status of the earplugs in question as “pulled from the market,” 3M says that is not the case. That model was “discontinued” in 2015. It was replaced by new versions that were already on the market.
